Dutch Gaming Authority’s New General Fine Policy in Force

Effective 1 January, the Dutch Gaming Authority (Ksa) has implemented a new general fine policy. This policy provides more detailed guidelines for imposing fines and offers greater clarity to gambling providers and other entities under its supervision.

The general fine policy applies to all violations that the Ksa oversees. Previously, the authority had separate fine policies for illegal online supply, illegal operation of gaming machines, and gambling terminals. These remain under their respective policy rules due to a different fine system being used.

The new policy categorizes fines into five levels, with basic fines ranging from €500 (category 1) to €2,000,000 (category 5). The highest category fines (category 5) are only imposed for Wwft violations. For non-Wwft violations in category 4, the Ksa can impose a turnover-related fine of 3% of the offender’s gross turnover to enhance the effectiveness of the fine.

Michel Groothuizen, chairman of the board at the Ksa, stated, > “The Ksa is becoming increasingly professional as an organization. After the opening of the online market in 2021, we were given a new category of license holders. In 2022, we imposed a first fine on a license holder. We have now gained enough experience to arrive at a well-considered fine policy for both license holders and other parties. This creates clarity for the parties under our supervision and hopefully motivates them even more to avoid fines.”

This new policy aims to ensure better compliance and clarity for all entities under the Ksa’s supervision, encouraging them to adhere to regulations and avoid penalties.
