ACMA Fines PointsBet for Violating Spam and Self-Exclusion Laws

The Australian Communications and Media Authority (ACMA) has issued a significant penalty against PointsBet Australia, fining the company AUD 500,800 for breaching the nation’s spam regulations and gambling self-exclusion laws.

Violation of Marketing Rules

Following an ACMA investigation, PointsBet was found to have sent approximately 800 unauthorized messages, violating Australia’s anti-spam laws. These violations included:

  • 705 promotional emails sent between September and November 2023, each containing a direct link to PointsBet’s wagering platform.
  • 7 marketing emails sent without recipient consent.
  • 90 commercial text messages lacking proper contact information.

Additionally, PointsBet mischaracterized these emails as ‘non-commercial’, despite them clearly promoting gambling services—making them subject to Australia’s spam regulations.

Targeting Self-Excluded Individuals

The National Self-Exclusion Register (NSER) identified that PointsBet sent 508 marketing messages to self-excluded individuals between August and September 2023, a direct violation of gambling laws intended to protect vulnerable players.

While no self-excluded customers were able to place bets during this period, the messages still represented a serious breach of responsible gaming safeguards. In response, PointsBet has agreed to an enforceable undertaking, committing to improved compliance with spam laws and regular staff training on responsible marketing practices.

ACMA’s Stance on Responsible Gambling

ACMA Chair Nerida O’Loughlin condemned PointsBet’s actions, emphasizing the critical responsibility of gambling operators to protect vulnerable individuals.

She reaffirmed that operators must comply with regulations and promote responsible gambling initiatives, adding that ACMA will closely monitor PointsBet’s future compliance.

Future Implications

Due to the complex nature of this investigation, ACMA was unable to impose further financial penalties related to marketing breaches against self-excluded players. However, failure to honor the enforceable undertaking could result in court-ordered fines.

Meanwhile, PointsBet is evaluating takeover proposals, including offers from Betr and MIXI, as it navigates the evolving regulatory landscape.
